The IRS says you are either married or you're not. So for their purposes your friend was married at the end of tax year 2005. However that doesn't mean that he MUST claim his wife, only that the option is available. The can each file as "Married filing Separately" and each can claim themselves. It might be better for them to agree to file jointly since they would probably pay less tax that way. If they aren't on speaking terms this option is most likely out.
